Welcome to the website of Charitable Organisation "Charitable Foundation Star for Life Ukraine" (referred to in these Terms of Use as "SFLUA", "we", "us", or "our").

By accessing or using the Website, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Website.

2. Who Can Use the Website 

The Website is open to general audiences worldwide, including residents of Ukraine and international visitors. 

Some sections of the Website (such as Kids' Stories, educational content, and information about our programmes) may be of particular interest to children and young people. We support age-appropriate access by minors. 

However, the following functions are restricted to legal adults (18 years of age or older): 

• Making financial donations 

• Submitting volunteer, partnership, or employment applications 

• Subscribing to our newsletter using a personal email address 

• Entering into any other binding agreement with us through the Website 

If you are under 18, please obtain consent from a parent or legal guardian before submitting any personal information through the Website. Parents and guardians are responsible for supervising children's use of the Website.

4. Prohibited Use 

You must not use the Website to: 

• Engage in or facilitate any unlawful activity under Ukrainian or applicable international law 

• Harm, threaten, harass, contact, or attempt to identify children or beneficiaries featured on the Website 

• Send unsolicited communications (spam), malware, viruses, or any other harmful code 

• Attempt to gain unauthorised access to the Website, related systems, donor accounts, or staff communications 

• Use automated tools (bots, scrapers, crawlers) in a way that disrupts normal Website operation 

• Impersonate SFLUA, our staff, partners, board members, ambassadors, or beneficiaries 

• Make donations using fraudulent payment methods, stolen financial details, or funds derived from illegal sources 

• Use SFLUA's name, logo, or trademarks (including "Star for Life" and "Star for Life Ukraine") without prior written permission

• Engage in any activity that could damage our reputation or the dignity of the children, families, and communities we serve 

We treat violations seriously. Where appropriate, we will report illegal conduct to Ukrainian law enforcement, payment service providers, and our partners. We will fully cooperate with any official investigation. 
 

5. Intellectual Property 

All content published on the Website — including text, photographs, videos, illustrations, logos, designs, audio recordings, software, and the overall look and feel — is owned by SFLUA, our staff, our partners, or licensed to us by third parties. 

This content is protected by: 

• The Civil Code of Ukraine 

• The Law of Ukraine "On Copyright and Related Rights" 

• International copyright treaties to which Ukraine is a party (including the Berne Convention) 

"Star for Life" and "Star for Life Ukraine" are trademarks of Star for Life International or SFLUA. The Star for Life logo and visual identity are used under agreement from Star for Life International.

7. Protection of Children — Our Commitment 

SFLUA is committed to the safeguarding and protection of children. We operate in line with: 

• The international Keeping Children Safe (KCS) standards 

• The Law of Ukraine "On the Protection of Childhood" 

• Our internal Safeguarding Policy, available on request 

What this means on our Website 

• We do not publish identifying personal information (such as full names combined with school, address, or other locating details) of children without explicit consent from a parent or legal guardian. 

• Photographs and stories of children are used only with documented consent and are reviewed for dignity, privacy, and safety before publication. 

• We do not facilitate direct contact between members of the public and individual children. 

• Where we share children's experiences using pseudonyms, composite stories, or anonymised case studies, we clearly identify them as such.

8. Donations 

When you make a donation through the Website, you accept our Public Offer Agreement (available at www.sflua.org/public-offer), which governs: 

• How donations are processed and the payment methods accepted 

• How donated funds will be used in support of our charitable activities 

• Refund eligibility (limited to specific circumstances, such as confirmed fraudulent transactions) 

• Tax receipt requests, where applicable under Ukrainian or international law 

As a registered Ukrainian charity, we are required by the Law of Ukraine "On Charitable Activities and Charitable Organisations" to use donations exclusively for our statutory charitable purposes. Donations are never used for the private benefit of any individual. 

We reserve the right to refuse or return donations from individuals or entities subject to international sanctions, where there is reasonable suspicion of money laundering, or where acceptance would conflict with our values, mission, or legal obligations.

If you are a resident of a country other than Ukraine, this clause does not deprive you of any mandatory consumer protections that apply to you under the law of your country of residence. 
 

19. Dispute Resolution 

Before initiating any formal proceedings, please contact us at team@starforlife.org.ua to describe your concern. We will: 

• Acknowledge receipt within 5 business days 

• Provide a substantive response within 14 business days 

• Work in good faith to resolve any issue directly 

If we cannot resolve the matter directly, you may bring the dispute before the competent courts of Ukraine, or use any other available legal procedure (such as mediation), at your option. 
 

20. General Provisions 

Severability 

If any part of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions will continue in full force and effect. The invalid part will, to the extent possible, be replaced by a provision that achieves the original intent in a lawful manner. 

No waiver 

Our failure to enforce any right or provision under these Terms at any time does not constitute a waiver of that right or provision. 

Entire agreement 

These Terms — together with our Privacy Policy, Public Offer Agreement, Cookie Notice, and any other documents referenced within them — constitute the complete agreement between you and SFLUA regarding your use of the Website. They supersede any previous Terms of Use and Conditions. 

Language 

These Terms are published in English. A Ukrainian-language version may be published for convenience. In the event of any conflict between the English and Ukrainian versions, the Ukrainian version shall prevail.
